How to Request a Waiver of Overpayment of Disability Benefits HD

What should you do if you receive a “notice of overpayment” and demand for repayment from Social Security? Overpayment cases happen when Social Security pays you monthly benefits when you are not eligible for those benefits. For example, if you are an SSDI recipient and you use up all of your trial work period months, you could find yourself in overpayment status. Similarly, if you are receiving SSI, and you household income goes up or if you start working, SSA could claim you are being overpaid. Sometimes, Social Security does not catch the overpayment for several years - imagine getting a letter saying that you owe $20,000, $30,000 or more and please send us a check within the next 2 weeks! SSA may also threaten to withhold some or all of your monthly benefit to pay back the overpayment. As I discuss in this video, you do have options if you find yourself in overpayment status. First, you should always check Social Security’s math - they have been known to make calculation mistakes. Second, you can request a waiver of overpayment by filling out Form SSA-632 - see https://www.ssa.gov/forms/ssa-632.html Third, you can request a hearing on the overpayment issue and argue to an administrative law judge that you should not be responsible for repaying the overpaid funds for reasons like the ones I discuss in this video. Finally, remember that in most cases you can file bankruptcy to discharge overpaid funds, while continuing to receive your regular monthly payment.
