CROSS EXAMINATION: What Are the ONLY Answers I Expect a Doctor to Give During Trial in New York? https://www.oginski-law.com/library/cross-examination-strategies-in-ny-civil-lawsuits.cfm When cross examining a doctor or medical expert in a medical malpractice trial, there are really only four answers you want from the witness. Cross examination is an opportunity for a lawyer to tell the jury a story. Assuming he asks short, leading questions, you would only expect the doctor to answer in these four typical ways: 1. “Yes“ 2. “No“ 3. “I can’t answer the question the way you phrased it“ 4. “I don’t know“ That’s it. Those are the four ways and only ways I want the doctor to answer my questions. If the doctor begins to explain any of his answers, it means I’ve done something wrong. It means have not asked the question appropriately. It means I have not set the ground rules for the witness. Want more information about how these types of cases work in New York?
